Terms of Service

Fire Flow Media provides done-for-you social media management services including social media content creation and copywriting; post design and visual content production; scheduling and automated publishing to Instagram, Facebook, and Google Business Profile; monthly performance reporting; and client special and promotional post creation upon request. The specific scope of services depends on the subscription plan you select.

Fire Flow Media offers the following monthly subscription plans: Starter at $297.00 per month for 12 posts per month; Growth at $497.00 per month for 20 posts per month; Premium at $697.00 per month for 30 posts per month; and Unlimited at $997.00 per month for daily posting plus Stories.

All subscriptions are billed on a recurring monthly basis through Stripe, Inc. Your subscription renews automatically on the same day each month unless cancelled in accordance with the cancellation section of these Terms. By providing your payment information you authorize Fire Flow Media to charge your payment method on a recurring basis. We reserve the right to modify pricing with no less than 30 days' written notice to active clients.

If a payment fails we will notify you and attempt to process the charge again within 3 business days. If payment cannot be collected after two attempts, services may be suspended until payment is received.

Full Refund Within 24 Hours

If you cancel within 24 hours of your initial purchase and no content has been created or published on your behalf, you are entitled to a full refund processed through Stripe to your original payment method.

Partial Refund After 24 Hours

If you cancel after 24 hours but before the end of your first billing period and content has been created and/or published on your behalf, you may be eligible for a partial refund at our sole discretion, calculated based on the proportion of the billing period remaining minus the value of content already created and delivered. We will communicate any partial refund determination within 5 business days of your cancellation request.

No Refund on Renewals

For all subscription renewals after the initial billing period, no refunds will be issued. You may cancel at any time and your service will continue through the end of the current paid billing period.

All refund requests must be submitted in writing to hello@fireflowmedia.com.

You may cancel your subscription at any time by providing written notice to hello@fireflowmedia.com. Cancellations require a minimum of 30 days' written notice. Upon receipt of your cancellation notice, your service will continue through the end of your current billing period and will not renew thereafter.

Fire Flow Media reserves the right to cancel or suspend service immediately without refund if you violate any provision of these Terms, provide false or misleading information, use our services in connection with illegal activity, or if payment cannot be collected. We reserve the right to cancel your subscription with 30 days' notice for any other reason, in which case a prorated refund for the unused portion of your billing period will be issued.

You are responsible for providing Fire Flow Media with the necessary permissions to access and publish content to your social media accounts through each platform's official manager or partner settings. You represent that you have the legal authority to grant such access. Any photos, logos, graphics, or other materials you provide must be owned by you or licensed for commercial use and must not infringe on any third-party intellectual property rights.

You are responsible for ensuring your business and social media accounts comply with the terms of service of Instagram, Facebook, Google, and any other platforms where we publish on your behalf. You agree to notify Fire Flow Media immediately of any platform warnings, violations, or account restrictions.

All social media content created by Fire Flow Media on your behalf becomes your property upon creation. You retain full ownership of all content published to your social media accounts.

Notwithstanding the above, you grant Fire Flow Media a non-exclusive, royalty-free, perpetual license to use, display, and reproduce examples of content created for you, including screenshots, mockups, and references to your brand, for our own marketing, advertising, portfolio, and promotional purposes. We will not disclose confidential business information in any such use.

Content may incorporate stock images and design elements sourced from licensed third-party providers. Fire Flow Media makes no representation that third-party assets are available for use outside of the context in which they were originally provided.

Fire Flow Media will make commercially reasonable efforts to ensure that all content created on your behalf complies with the published community guidelines of Instagram, Facebook, and Google Business Profile as they exist at the time of content creation.

Fire Flow Media is not responsible for and shall have no liability in connection with suspension, restriction, or termination of your social media accounts by any platform; platform algorithm changes that affect reach, engagement, or visibility; negative reactions, comments, or responses from third parties to content we publish; account actions resulting from your own posts, comments, stories, or other activity outside of content created by Fire Flow Media; account actions resulting from violations that predated your engagement with Fire Flow Media; or changes to platform policies that render previously compliant content non-compliant.

In the event that content created by Fire Flow Media directly and solely causes a verifiable platform violation resulting in account suspension, we will work with you in good faith to address the situation, and our liability in such cases is limited to the value of one month of your subscription fee.

Fire Flow Media relies on third-party platforms and tools including Predis.ai, Buffer, Stripe, Google, Instagram, and Facebook to deliver our services. We are not responsible for outages, errors, API changes, or service interruptions caused by these third-party providers.

In the event of a material service interruption caused by third-party tool failure that prevents us from publishing content for a period exceeding 48 consecutive hours, Fire Flow Media will notify affected clients by email within 24 hours of becoming aware of the interruption, provide status updates every 48 hours until service is restored, and at our discretion offer affected clients either a prorated service credit or an extended service period equal to the duration of the interruption.

Fire Flow Media shall not be liable for any failure or delay in performance arising from circumstances beyond our reasonable control, including natural disasters, acts of government, platform shutdowns, internet outages, or other force majeure events.

Fire Flow Media agrees to treat all non-public information you share with us, including business strategies, customer data, financial information, and proprietary materials, as confidential. We will not disclose your confidential information to any third party except as necessary to provide our services or as required by law.

Fire Flow Media provides its services on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our services will meet your specific business objectives, increase your followers or engagement, generate sales or leads, or achieve any particular marketing result.

To the maximum extent permitted by applicable law, Fire Flow Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities. Our total cumulative liability to you shall not exceed the total amount paid by you to Fire Flow Media in the three months immediately preceding the event giving rise to the claim.

You agree to indemnify, defend, and hold harmless Fire Flow Media and its owner, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your violation of these Terms; your violation of any third-party right; any content or materials you provide to Fire Flow Media; your use of social media platforms in violation of their terms of service; or any false or misleading information you provide.

These Terms shall be governed by and construed in accordance with the laws of the State of Washington. Before initiating any formal legal proceeding, both parties agree to attempt to resolve any dispute informally by contacting the other party in writing and attempting to negotiate a resolution in good faith for a period of 30 days. If informal resolution fails, any legal action shall be brought exclusively in the state or federal courts located in Washington State, and both parties consent to the personal jurisdiction of such courts.

We reserve the right to modify these Terms at any time. Active clients will be notified by email at least 14 days before material changes take effect. Your continued use of our services after the effective date constitutes acceptance of the updated Terms.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fire Flow Media with respect to our services.
